Moral philosophers have often felt the need of a concept which would cover all those cases where we are prevented from achieving our ends through no fault of our own: a criterion for saying when failure is not blameworthy. The deontologists thought we were not to blame for actions done in genuine ignorance of the facts. Kant declared in a famous passage that we were not morally responsible for failures due to the “niggardliness of stepmother nature.” In this article I (...) want to introduce into moral philosophy a new concept for clarifying the failures for which we are not to blame: the notion of scarcity, taken from economic theory. State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...) wrongdoing by physicians. The Essay concerning Human Understanding was published at the end of 1689.1 It sold well, and within three years Locke was planning revisions for a second edition. Among those whose “advice and assistance” he sought was the Irish scientist William Molyneux. Locke had begun a correspondence with Molyneux a few months before, after the latter had lavishly praised the Essay and its author in the Epistle Dedicatory of his own Dioptrica Nova, published early in 1692. Here was a man, Locke (...) concluded, whose judgment one could trust. He returned Molyneux’s compliment in the Essay’s new edition, calling him “that very Ingenious and Studious promoter of real Knowledge, ... whom I am proud to call my friend”. (shrink)

I do not think it would be fair for me to reply to Professor Spiegelberg’s rejoinder without giving him the chance to reply in turn to my reply. The first speaker in a symposium should always, I believe, have the last word. But by that principle I am entitled to a reply to Professor Chisholm, for whom, in his original paper, I was a primary target.

A more significant indication of the revived interest in Whitehead, however, is the number of first-rate studies of his philosophy which have been produced in recent years. Three have been published; each is superior in scope, depth, and philosophic insight to the studies hitherto available. In addition, two more works are announced for early publication, one of which at least is of the same high caliber. The authors of these recent books are neither apologists nor detractors, neither loyal disciples nor (...) ideological enemies of their subject. In the main they are themselves philosophers, concerned to understand and to help others understand the constructions of a philosophic master builder, one who, unfortunately, did not himself do all he might have done to facilitate such understanding. We have long needed studies of the sort now appearing. More work is needed for our comprehension to be complete, and our assessments sure. But these recent books have brought these goals within striking distance. (shrink)

Attention has been drawn, particularly since Kant, to propositions which can not have negative instances. They used to be called a priori, axioms, first principles. Today, they are usually called postulates—C. I. Lewis uses both the old and new terminology—because there is a growing recognition of the fact that at least some of them are not “necessary” in the traditional sense. Kant placed a limitation on the apriorism of the continental rationalists. Current epistemologists and logicians have outstripped Kant in the (...) direction signalled by him. Both he and they, however, concur in the opinion that apriori propositions are subject to negation of a sort. The Kantian dinge-an-sich, though they can not contradict these propositions by being negative instances of them, do nevertheless stand to them in the relation of insubordination, thereby exerting on them a “negative action” of a sort. And, according to current views, there are instances which, though they fall outside the range of significance of a proposition or system and hence can not contradict it, do nevertheless tend to bring about a revision of it by a negative action of some sort. The purpose of this brief essay is to coin a convenient name for such instances and to describe certain properties of their peculiar negative action. (shrink)

In this paper, I argue that scholars such as John Braithwaite and Lode Walgrave rely on fictions when presenting their utopian vision of restorative justice. Three claims in particular are shown to be fictitious. Proponents of restorative justice maintain, first, that the offender and the victim voluntarily attend the restorative conference. Second, that the restorative conference enables the offender and the victim to take on active responsibility. Third, that the reparatory tasks on which the parties agree should not be understood (...) in terms of the intentional infliction of harm. These fictions, so I argue, are not merely a mistake, but instead serve an important function: the various parties need to believe that they adequately capture the reality of the restorative conference as they are more likely to acquiesce if they believe the fictions to be true. I conclude that the fictions are the driving force within the restorative endeavour. (shrink)

Surgeons have an ethical obligation to ensure all patients, regardless of their personal characteristics, receive the same quality of care. Established surgeons also have an obligation to ensure equal treatment for their peers and for those who would like to join the field. The commitment to ethical hiring and working standards entails making certain all individuals have the same opportunities free from discriminatory practices. The world of business has long realized the positive implications of having a diverse and inclusive workforce. (...) Studies have shown a positive correlation between increased racial and gender diversity and company performance. Diversity can lead to an increase in knowledge by sharing ideas with individuals who come from different life experiences and breakdown cultural barriers. We have already begun to see the impact of ignoring the importance of diversity within healthcare, including surgery. Healthcare disparities are defined by the NIH as “differences in the incidence, prevalence, mortality, and burden of diseases and other adverse health conditions that exist among specific population groups.” Healthcare disparities persist despite decades acknowledging their existence, and they are pernicious and prevalent in surgery. One proposed method to help reduce or eliminate healthcare disparities is to increase the diversity of the workforce treating the patients, which would in turn reduce potential bias the patients face in the healthcare setting. Implicit bias can play a key role in interactions with patients and colleagues and needs to be explored on an individual basis. Cultural competence training can also provide surgeons the ability to effectively communicate with not only a diverse population of patients but also a diverse surgical workforce. All surgeons regardless of their role can have a positive impact on diversity as it relates to patient care and the surgical workforce. (shrink)

Known as the founder of the phenomenological movement, this book examines Husserl's various phases of phenomenology during his realist, transcendental, static, genetic, and post-Crisis (of European Sciences) periods. Consisting of ten carefully researched and thoroughly examined essays, this book describes Husserl's concepts and ideas through numerous examples and diagrammatic representations, in a bid to elucidate the nuances of phenomenology for its readers. Valuable insights into Husserl's realist phase are made in the chapter on Meaning, and the chapters on Natural Attitude, (...) Epoché and Phenomenological Reduction, while the chapter on Noesis & Noema symbolizes the transcendental phase. Thomas points out Husserl's transition from static to genetic phenomenology in the chapter on Lived Body, with the chapters on Lifeworld, and the Notion of the Other, later focusing on this perspective. Husserl's entire phenomenological space, including his pre-phenomenological period, are covered in the chapter on Lived Time. However, the chapters on Phenomenology: The Study of Self and Beyond, and Consciousness and Intentionality are the fulcrums upon which the edifice of phenomenology turns. The final chapter on Presuppositionlessness in phenomenology expresses Thomas' personal enquiries into Husserl's contention that phenomenology is a presuppositionless science. This book will be of particular interest to research scholars and post-graduate students in the areas of Philosophy and Social Sciences, as well as those interested in contemporary Western Philosophy, and the history and development of Ideas. Eleven essays, on a variety of topics, most of them first given as lectures or published in periodicals and Festschriften. This is "late" Heidegger --alternately brilliant and mystifying, provocative and exasperating, at least to the uninitiated. Perhaps the best pieces in the book are the three which discuss passages in pre-Socratic philosophers--here, familiar texts are given fresh, if unorthodox, interpretations, and are made to suggest philosophical conclusions of remarkable subtlety and scope. --V.
